Advisory Board members announced ahead of Fair Work Agency's April launch

The Government has announced the appointment of the nine members of the first Fair Work Agency Advisory Board. The Fair Work Agency will be launched on 7 April 2026 and will bring together existing state enforcement functions (including the Gangmaster and Labour Abuse Authority, the Director of Labour Market Enforcement, the Employment Agency Standards Inspectorate and HMRC's National Minimum Wage Unit) and take on enforcement of a range of employment rights.  

The Fair Work Agency will have powers to:

  • inspect workplaces and require production of documents and evidence;
  • issue Notices of Underpayment (requiring the employer to pay the employee and pay a penalty to government), where officers find that an employer has underpaid workers;
  • bring proceedings in the employment tribunal on a worker’s behalf;
  • offer legal advice and assistance;
  • require employers to correct their behaviour in respect of labour market criminal offences, using an enforcement regime; and
  • impose charges to recover enforcement costs.

 

The Advisory Board has an equal number of members with independent, employer and trade union backgrounds to ensure that the work of the Fair Work Agency is rooted in the experience of businesses, workers and victims of serious labour exploitation. The board members are recognised leaders and experts in employment rights.
