We are unquestionably seeing a marked rise in unmeritorious claims being brought against our clients, many of which appear to be generated or heavily facilitated by AI tools. These claims are often poorly substantiated, formulaic in nature, and lacking in a proper understanding of the underlying facts or legal thresholds, yet they still require time and resource to assess and respond to. This trend is placing an increasing and, frankly, unnecessary burden on both clients and legal teams.
That said, it is encouraging that this issue is beginning to receive more prominent, high‑profile attention. Greater visibility should help drive more informed discussion around the risks associated with the misuse of AI in this context, and ideally lead to clearer guidance, safeguards, or procedural mechanisms to deter speculative or automated mass claims of this kind.
