Complying with sponsorship duties under the Skilled Worker route in education
Appendix D to the Home Office sponsor guidance sets out the mandatory record‑keeping requirements for all sponsor licence holders. These requirements are not optional and sponsors are expected to hold the prescribed documents in full. Reliance on standard HR personnel files will rarely be sufficient, and any gaps are likely to be treated as non‑compliance in the event of a Home Office audit.
For educational institutions such as schools, academies, and colleges, holding a Skilled Worker sponsor licence carries a high level of responsibility. Sponsorship is a privilege rather than a right and must be exercised with care and in strict accordance with Home Office requirements.
A core component of these duties is effective record keeping. Sponsors must retain clear and accessible documentation for each sponsored worker. This includes evidence of the individual’s right to work in the UK, up‑to‑date (and historic) contact details, absence records and payslips, together with documents relating to the recruitment process. Institutions should also retain the materials submitted in support of their sponsor licence application, including job descriptions and recruitment evidence.
In an education setting, these obligations apply to both academic and non‑academic sponsored staff. Records must be stored securely but remain readily accessible for inspection. This is critical in preparing for compliance visits or unannounced audits.
Appendix D broadly categorises the required documentation as follows:
- evidence of right to work
- evidence of recruitment
- evidence of salary
- evidence of skill level
- additional supporting documentation
